In this case I doubt it's a problem, but Specialised manage to collect license fees for 4-bar bicycle suspensions in the States which they can't do in Europe since there's prior art for that one too so they couldn't get a patent over here. It's just cheaper to pay the fees than it is to go to court. An example of how big companies can abuse the system to stifle smaller ones.
